Third-Party Logistics Provider Shipping Policy

This Third-Party Logistics Provider Shipping Policy (“Policy”) applies when Cue Joint Venture, LLC and/or Cued Billiards; DBA (“Company,” “we,” “our,” or “us”) ships products to a Global Logistics Provider or other third-party freight forwarder (“Third-Party Provider”) designated by the purchaser (“Customer,” “you,” or “your”).
By instructing us to ship your order to a Third-Party Provider, you acknowledge and agree to the terms and conditions set forth in this Policy, in addition to our standard Shipping Policy and Terms of Sale.
1. Definition of Third-Party Provider
A “Third-Party Provider” is any logistics company, freight forwarder, parcel consolidation service, or other intermediary that accepts delivery of goods from us on your behalf and subsequently ships or transports the goods to another destination, whether domestic or international.
2. Transfer of Title & Risk of Loss
- Title to and risk of loss for products pass to you upon delivery to the Third-Party Provider.
- Once we deliver the products to the Third-Party Provider’s address, our shipping obligation is fully satisfied.
- We are not responsible for, and will not replace, refund, or repair, goods lost, damaged, delayed, or misdelivered after transfer to the Third-Party Provider.
3. Inspection Upon Receipt by Third-Party Provider
- The Customer is solely responsible for ensuring that the Third-Party Provider inspects all items upon delivery from us for accuracy, quantity, and condition.
- Any shortages, incorrect items, or visible damage must be reported to us in writing within [2] business days from the date the order is marked delivered to the Third-Party Provider by the carrier.
- After this period, all claims are waived.
4. Warranty & Returns Limitations
- Our product warranties, return, and exchange policies apply only to goods in the same condition as shipped from our facility.
- If the Third-Party Provider opens, repackages, consolidates, or alters the goods in any way, all warranties may be void.
- We are not responsible for compliance with the import laws, safety regulations, or labeling requirements of the final destination country.
5. Export & Customs Compliance
- The Customer is solely responsible for compliance with all export regulations, import restrictions, tariffs, duties, taxes, and any other governmental requirements applicable to the final destination.
- We will not falsify invoices, alter product descriptions, or misstate values for customs purposes.
6. Communication & Disputes
- All inquiries regarding transit, customs clearance, or final delivery after the order reaches the Third-Party Provider must be directed to the Third-Party Provider.
- We will cooperate reasonably to provide shipping records, invoices, and product descriptions as needed to assist with the Customer’s claim against the Third-Party Provider.
7. No Liability for Third-Party Acts or Omissions
We are not liable for:
- Delays, damages, or losses occurring while goods are in the possession of the Third-Party Provider;
- Misdelivery or failure to deliver by the Third-Party Provider;
- Improper handling, storage, or repackaging by the Third-Party Provider; or
- Non-compliance with foreign import or export regulations.
8. Policy Changes
We reserve the right to amend this Policy at any time without prior notice. Updated versions will be posted on our website and will apply to all orders placed thereafter.
